1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of Paxaver, a school community platform operated by Smartoire ("we," "us," or "our"). By creating an account, accessing, or using Paxaver in any way, you agree to be bound by these Terms. If you are entering into these Terms on behalf of a school, organization, or group, you represent that you have the authority to bind that entity. If you do not agree with any part of these Terms, you must not access or use the service.
2. Eligibility and Accounts
Paxaver is designed for use by schools, Parent Advisory Committees (PACs), parents, guardians, and authorized school community members. You must be at least 18 years of age or have the legal capacity to enter into a binding agreement to create an account. When you register, you must provide accurate, current, and complete information and keep your account credentials confidential. You are responsible for all activity that occurs under your account and must promptly notify us of any unauthorized use or security breach.
3. Service Description
Paxaver provides tools for hot lunch ordering, event management, volunteer coordination, fundraising, and communication between schools, PACs, and families. The service may be updated, modified, or discontinued at any time without prior notice.
4. Student Information
Student information is provided by parents, guardians, or school staff for the purpose of participating in school programs. Paxaver is not directed at children under the age of 13, and children do not create accounts or interact with the service directly. We comply with COPPA and FERPA where applicable. Schools using Paxaver are responsible for obtaining necessary consents from parents and guardians regarding the collection and use of student information.
5. Privacy
Your use of Paxaver is governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the service, you consent to the data practices described in the Privacy Policy.
6. Intellectual Property
Paxaver, including its name, logo, design, software, features, and all associated content, is the intellectual property of Smartoire and is protected by copyright, trademark, and other applicable laws. You may not copy, modify, distribute, or create derivative works based on Paxaver without our prior written consent.
7. Acceptable Use
You agree not to: (a) use the service for any unlawful purpose; (b) share your account credentials with others; (c) attempt to access data for students or schools you are not authorized to access; (d) disrupt or interfere with the service; (e) use the service to send unsolicited communications.
8. Disclaimer of Warranties
The service is provided "as is" and "as available" without warranties of any kind, whether express or implied. Smartoire does not warrant that the service will be uninterrupted, error-free, or secure.
9. Limitation of Liability
To the maximum extent permitted by law, Smartoire shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service.
10. Changes to Terms
Paxaver may update these Terms at any time. When significant changes are made, users will be required to accept the updated Terms at their next login. Continued use of the service after changes constitutes acceptance of the new Terms.
